Your rights under the No Surprises Act

You have the right to receive a Good Faith Estimate explaining how much your care will cost

Under the law, health care providers need to give patients who don't have insurance, or who aren't using insurance, an estimate of the bill for medical items and services.

  • You have the right to receive a Good Faith Estimate for the total expected cost of any non-emergency items or services. This includes related costs like medical tests, prescription drugs, equipment and hospital fees.
  • Make sure your health care provider gives you a Good Faith Estimate in writing at least 1 business day before your medical service or item. You can also ask your health care provider, and any other provider you choose, for a Good Faith Estimate before you schedule an item or service.
  • If you receive a bill that is at least $400 more than your Good Faith Estimate, you can dispute the bill.
  • Make sure to save a copy or picture of your Good Faith Estimate.

For questions or more information about your right to a Good Faith Estimate, visit www.cms.gov/nosurprises or call 1-800-985-3059.

At Onyx Wellness, every client receives a written Good Faith Estimate before their first session. To request one, contact us at hello@onyxwellness.care.

Your rights

You have the right to:

  • Get a copy of your records. Ask us for an electronic or paper copy. We'll respond within 30 days and may charge a reasonable, cost-based fee.
  • Ask us to correct your records if you think they're incorrect or incomplete. We may say no, but we'll tell you why in writing within 60 days.
  • Request confidential communications, for example a specific phone number or email. We'll agree to all reasonable requests.
  • Ask us to limit what we use or share. We aren't required to agree, except that we must agree not to share information with your health plan about services you've paid for in full out of pocket.
  • Get a list of those we've shared information with (an accounting of disclosures) for the past six years, with some exceptions.
  • Get a copy of this notice at any time, including on paper.
  • Choose someone to act for you, such as a legal guardian or someone with medical power of attorney.
  • File a complaint if you believe your rights were violated. Contact our privacy contact above, or the U.S. Department of Health and Human Services Office for Civil Rights at www.hhs.gov/ocr/complaints or 1-877-696-6775. We won't retaliate against you for filing a complaint.

Your choices

You can tell us your preference about sharing information with family or others involved in your care, and in a disaster-relief situation. If you can't tell us (for example, if you're unconscious), we may share information if we believe it's in your best interest, or when needed to lessen a serious and imminent threat to health or safety.

We never share your information without your written permission for: marketing purposes, sale of your information, or, in most cases, psychotherapy notes.

How we use and share your information

  • Treatment: your clinician uses your information to provide care, and may consult with Onyx's Clinical Director.
  • Operations: to run the practice, improve care, and handle scheduling and administration. Administrative staff see only what they need.
  • Payment: to bill you and collect payment. Onyx doesn't bill insurance; if you ask for a superbill, you choose whether to send it to your insurer.

Other ways we may share information (as permitted or required by law)

  • To report suspected abuse or neglect of a child, elder adult or disabled adult, as Georgia law requires
  • To prevent or lessen a serious threat to anyone's health or safety
  • In response to a court order, or as otherwise required by law
  • For health oversight activities (for example, licensing board investigations)
  • To comply with law enforcement or government requests, where the law requires it
  • To coroners, medical examiners or funeral directors, as the law allows

Georgia law may give mental health information more protection than federal law. When it does, we follow the stricter rule.

Our responsibilities

  • We are required by law to keep your health information private and secure.
  • We will tell you promptly if a breach occurs that may have compromised your information.
  • We must follow the duties and privacy practices in this notice and give you a copy.
  • We won't use or share your information other than as described here unless you tell us we can in writing. You may change your mind at any time by letting us know in writing.

Changes to this notice

We may change this notice, and changes will apply to all information we have about you. The new notice will be available on request, on our website and in the client portal.
